Know Your Rights: Free Red Cards Available in the University Union and Cal Poly Recreation Center

“All people in the United States, regardless of immigration status, have certain rights and protections under the U.S. Constitution,” according to the Immigrant Legal Resource Center (ILRC).

As part of the ILRC’s educational materials, the non-profit organization has created red cards that state an individual’s rights and protections under the Fourth and Fifth Amendments. The cards provide the following advice in circumstances where an immigration agent is questioning an individual or attempting to enter a residence:

  • Do not open the door if an immigration agent is knocking on the door.
  • Do not answer any questions from an immigration agent if they try to talk to you. You have the right to remain silent.
  • Do not sign anything without first speaking to a lawyer. You have the right to speak with a lawyer.
  • If you are outside of your home, ask the agent if you are free to leave and if they say yes, leave calmly.
  • Give this card to the agent. If you are inside of your home, show the card through the window or slide it under the door.

Free red cards are available at the Cal Poly Recreation Center Membership Services desk, the ASI Student Government office, and the facility supervisor desk on the second floor of the Julian A. McPhee University Union. Rights and protections are printed on all cards in both English and Spanish.

"Red cards are an accessible resource that can help U.S. citizens and non-citizens communicate their Fourth and Fifth Amendment rights,” Gabriela Guillen, ASI Board of Directors representative for the College of Science and Mathematics, said. “We are happy to have worked with the Cal Poly Dream Center to make these cards available to the campus community."
